Updating Outdated Law: A Citizen’s Petition to Update The Communist Control Act

Introduction

In 1954, Congress declared open war on communism inside America.
They declared it “Unconstitutional”. They passed it into law.
The Communist Party of the United States was labeled a clear and present danger to the Republic… and outlawed.

Not to be debated. Not to be tolerated… Outlawed.

Today, Marxism, Communism and Socialism march openly on our campuses. They have infested our judicial system, and worst of all… They’re in our Legislative branch. But they shouldn’t be… It is against the Law. A living breathing law that everyone has forgotten.

50 U.S. Code §§ 841–844 – The Communist Control Act of 1954 was passed into law with broad bipartisan support and signed into law by President Eisenhower. And for a while, it worked. But after facing numerous setbacks against the 1st and 5th amendments, it became hard to enforce. But instead of updating, amending, or rewriting the law… they abandoned it.

Today, it seems more prudent than ever that our sovereignty depends on resurrecting – and updating – this 70-Year-old law. Because the names they call themselves has changed, but the reason this law was needed hasn’t.


The Issue

Who is impacted?

The outdated language and scope of 50 U.S. Code §§ 841–844 (The Communist Control Act of 1954) affects every American by failing to address the realities of modern national security threats from within. These statutes were designed for a Cold War-era context, targeting a specific subversive organization (CPUSA).

Today, however, domestic extremist groups, unconstitutional ideologies, and foreign influence operations operate in ways that bypass these legal definitions. Citizens are left vulnerable to threats that exploit legal blind spots, while law enforcement and policymakers lack the tools to respond effectively within constitutional bounds.

What is at stake?

This law originally forbid Communists from holding public office. While still an active law, enforcement has fallen by the wayside. We currently have Socialists in office and Communists running for office. But this law goes ignored.

If these statutes remain unchanged, the U.S. risks relying on antiquated legal frameworks that do not reflect current threats or realities. This gap undermines national security, weakens oversight, and leaves room for both abuse and inaction. 

Updating these laws with modern definitions, safeguards, and oversight mechanisms would empower the government to act responsibly and constitutionally in the face of evolving threats—protecting both public safety and civil liberties.

What are we doing?

The Veterans group that is "Liberty Outpost" has worked up proposed legislative updates to this law that will be submitted to the DOJ and Congress for consideration. Some of the revisions we are proposing will help strengthen this law, as well as protect the liberty of those who choose to follow those ideologies.

We’ve addressed the legal issues around the 1st and 5th Amendments that plagued this law before by adding modern definitions, rebranding clauses, and definitive markers as to what does and doesn’t fall into the act.

UPDATE: The proposal has been sent to Senator Ted Cruz (R) TX and Senator Markwayne Mullin (R) OK for their hopeful support and advocation, with other still to come.

Let it be understood that this Act (and proposed updates) does not punish belief, nor silence dissent. It draws a clear line between liberty and subversion—between free expression and conspiratorial action. It affirms that public service is a sacred trust, and that those who seek it must do so without allegiance to ideologies that would dismantle the very system they aspire to serve.

Why is now the time to act?

The urgency of reform is clear: extremist ideologies are spreading online, in the real world, and in our schools. Violence is in our streets and legal ambiguity is hampering effective response. With rising concerns about domestic radicalization and foreign influence, now is the time to modernize our legal tools. 

This petition calls on the Department of Justice and Congress to act before outdated statutes become liabilities. We must ensure our laws evolve with the threats they’re meant to address—without compromising the constitutional principles they’re built on.
